Q My tenancy has run out and now my landlord has told me to leave. Do I have to go right now?
A No. You must first find out whether you are a licence or a tenant - you will need to get a housing advisor to go through the arrangements/agreement and try and work out whether you are a tenant. DO NOT JUST RELY ON WHAT YOUR LANDLORD HAS TOLD YOU OR THE WRITTEN AGREEMENT WITH YOUR LANDLORD.
Licencees are only owed reasonable notice. Some categories have protection from Eviction Act 77 and some do not.
Tenants need to be given 1 - 2 months notice. The landlord then needs to apply to court to get a court order before evicting you. This means s/he will need to convince the court that they have the right to repossess the property.
